These care and services are provided by qualified personnel under the conditions provided for in
Article 8 of this law.
Art. 5. - The manufacture, import and sale of contraceptive products are authorized under the
conditions set by the texts in force.
The terms of prescription, delivery and administration of contraceptive products are determined
under the same conditions.
The advertising of contraceptive methods is authorized by the Minister of Health, under the
conditions fixed by decree, according to public health requirements.
Art. 6. - In compliance with ethics, couples have the right to benefit, upon request, from medically
assisted procreation.
Art. 7. - Anyone sick with AIDS or living with HIV has the right to special assistance, basic care
and a guarantee of confidentiality.
The persons referred to in the first paragraph of this article, who engage in risky behavior favoring
the spread of the disease, are liable to sanctions under the conditions provided for in article 17 of
this law.
Chapter III. - Reproductive health staff
Art. 8. - Staff working in the field of reproductive health are required to comply with the standards
of competence, service protocols and rules of ethics relating to their profession or activity.
The standards of competence in reproductive health relating to each professional category are set by
decree.
Chapter IV. - Reproductive health rights
Art. 9. - Everyone has the right to decide freely on matters relating to reproductive health concerning
him/her, in compliance with the laws and regulations in force, public order and good morals.
Any couple or individual has the right to freely decide whether to procreate, to determine the number
of children and the spacing of their births.
Art. 10. - Everyone has the right to receive all reproductive health care without discrimination based
on age, sex, marital status, membership of an ethnic or religious group.
