The hearing was held in accordance with article 321-10 of the Criminal Procedure Code, and the accused declared that he wanted to be tried immediately; During the appeal, the State Counsel explained that in line with the above-mentioned charges, he had brought the abovementioned accused before the court at today's hearing, to defend himself on account of the above-mentioned charges against him; The Court then listened to the case at the said hearing; The accused was examined and the Court Registrar made a note of his answers; The victim was heard; The accused made his arguments to defend himself; After the arguments had been presented, the court ruled as follows: THE COURT, After examining the evidence presented; Having heard the answers of the accused; Having heard the victim’s testimonies; Having heard the submissions of the State Counsel; Having heard the arguments of the accused, who spoke last; I- FACTS On May 11, 2019, SALGO Pousraogo Idrissa filed a complaint against S.B at the Gendarmerie Territorial Brigade in Séguénéga. To back his complaint, he explained that on May 10, 2019, his child S.A and her friends were playing near S.B who was lying down and felt that the children's games disturbed his rest; after asking nicely and demanding that the children, who did not comply with his demands, should leave the premises, S.B grabbed a stick and moved towards them; the children ran away except for S.A who had not seen him coming; that this is how S.B got close to S.A and administered her a violent blow on her head. S.A collapsed and was rushed to the hospital where she died. The investigating officers of the above-mentioned Judicial Police Unit opened a detailed investigation to elucidate the facts and succeeded in apprehending the suspect, who had meanwhile fled to a neighbouring village to seek refuge. When questioned, he readily admitted the charges against him.
