In my view therefore the following order should be made: I 1.The appeal is upheld. 2.The sentence imposed by the magistrate is set aside. 3.The matter is referred back to the magistrate to impose sentence afresh after considering a report submitted in terms of s 276 A(l)(a) of the Criminal Procedure Act and any further evidence relevant to sentence which may be received by the trial court.
