worker;
Whereas S.O constantly encouraged C.R to get
into prostitution; that she usually to paid him
daily amounts of money; that she suffered
damages due to S.O’s action; that it appears
her request is grounded; it would thus be
appropriate to order S.O to pay to C.R CFA F
1,100,000 (one million one hundred thousand)
as damages;
C- RESTITUTION OF EXHIBITS
Whereas article 321-99 of the Criminal
Procedure Code provides that “the accused,
plaintiff, or the liable in tort can request from
the chamber seized for proceedings some
objects in the hands of justice. The court may by
its own motion order the restitution of such
objects”:
Whereas as it is, the two hospital books
registered as exhibit no. 2020-005 in the
Registry of the said court belong to C.R that she
requests for their restitution; that it would be
proper to order the restitution of C.R's hospital
books;
D- CONFISCATION OF EXHIBITS
Whereas according to article 213(1) of the Penal
Code the relevant jurisdiction can also order
the confiscation and/or the destruction of the
material that was used or meant to be used to
commit that offence or the product thereof:
Whereas as it is, the ledgers in S.O’s keeping,
used to record payments were placed under the
seal of justice; that it would be proper to order
the confiscation of open seals under the custody
of the Registry with reference no. 005-2020;
E- COSTS
Whereas article 321-91 of the Criminal
Procedure Code, outlines that any judgement
convicting an accused should also order the cost
against him;
