Art. 11. - Everyone benefits from the guarantee of confidentiality within the framework of the
provision of reproductive health services in accordance with the laws and regulations in force. No
information concerning him may be divulged without his express authorization. In addition, she has
the right to have information about her that is available to the service provider.
Art. 12. - Everyone has the right to information and appropriate education in reproductive health.
Art. 13. - All forms of violence, sexual abuse or inhuman or degrading treatment are treated in
accordance with the penal provisions in force.
Every child has the right to be protected from all forms of sexual exploitation and sexual abuse.
Everyone has the right to be protected from rape, sexual assault, sexual abuse and sexual harassment.
Art. 14. - The State and local communities have an obligation to ensure the safeguarding, promotion
and protection of the reproductive health of individuals and couples.
Groups and associations contribute to the promotion and protection of the reproductive health of
individuals and couples.
Chapter V. - Voluntary termination of pregnancy
Art. 15. - Voluntary termination of pregnancy is prohibited except when authorized by law. In no case
can it be considered as a contraceptive method.
Chapter VI. - Voluntary transmission of the AIDS virus and applicable penal sanctions
Art. 16. - A voluntary sexual transmission of AIDS is defined as the fact that a person, knowing that
he/she is a carrier of the AIDS virus, transmits it through unprotected sex.
This sexual transmission resulting from consented intercourse or obtained by violence, coercion, threat
or surprise constitutes the offense of voluntary transmission of the AIDS virus.
The accused person must be subjected to a screening test.
Art. 17. - When the transmission results from a consented sexual act, the partner, recognized firsttime carrier, incurs a prison sentence of two to five years and a fine of 100,000 francs to 1,000,000
francs. When the intercourse is obtained as a result of rape, the above sentences are doubled.
If the offense was committed on a child under the age of 13 or a person particularly vulnerable because
of his/her state of pregnancy, advanced age or condition of health resulting in a physical or mental
impairment, the culprit incurs the maximum penalty.
Art. 18. - If the transmission results from modes of voluntary transmission of the AIDS virus, other
than those provided for in article 16 of this law, the act is characterized as poisoning.
