OUEDRAOGO Aminata said that she was surprised by
DJINEKAMA Lucie's accusations because they were friends, and
at no time did she ever tell her that she was a victim of sexual
harassment by their director; that in addition, she spent her
free time in the office of the latter; that since her recruitment in
2015, P.S.M never wooed or harassed her, nor did she learn that
he harassed other women;
Once the investigation was completed, the entire file was
transmitted to the State Counsel of Faso who, in light of the
evidence against him, initiated proceedings against P.S.M
for sexual harassment following the direct summons procedure;
Heard on the stand, the defendant refuted facts of sexual
harassment raised against him by repeating statements he
made during the preliminary investigation; he explained that
their school recruits permanent teachers whose careers are
directly managed by the founders and non-permanent teachers
who are under his control; that he is therefore responsible for
recruiting non-permanent teachers upon application and
assess their possible requests for renewal later; that although
he does not inform them of the criteria for non-renewal, it is his
policy not to renew these requests more than once; that
as regards D.L, she was effectively under his directorship
during the 2016-2017 and 2017-2018 school years; that within
the performance of his duties, he has never asked D.L to
touch him and has never conditioned the renewal of her contract
by sexual intercourse; he acknowledged that there had been
sexual intercourse between the victim and him, but that this took
place outside the framework of work; that it was following his
invitations to have a drink that they then continued to his
house in sector 2 of Ouahigouya, where consensual sexual
intercourse took place on two occasions; that indeed, being
very sociable, D.L regularly came to his office where they had
lunch together and she confided about her personal problems
to him, and that they regularly did sports in the company
of her colleague OUEDRAOGO Aminata; that he justifies the nonrenewal of DJINEKAMA Lucie's contract for the 2018-2019
school year by her indecent dressing, her absences and
repeated lateness, although the latter had achieved the objectives
assigned to her;
Heard at the bar, the victim maintained the statements she
made during the police investigation; She claimed that contrary to
the statement of P.S.M according to which a second sexual
intercourse had taken place between them on his birthday, there
was sexual intercourse between them only once during the
month of July 2017 and this was the condition for her contract
to be renewed;
Heard, the witnesses, including SAMPEBGO Angèle,
BADINI Manam, BARRY Mamadou Michel, PARE Henry
Bonaventure and OUEDRAOGO Aminata reiterated the
statements they made at the preliminary investigation;
