3°) Aguélou ALPHAGALO: a) for being, in Omo, Rural Municipality of Bondo, Koro Circle, on the 14th of March 2005, in any case less than ten years ago, an accomplice to the offence of false confinement by knowingly providing his home as place for the false confinement of Halimatou Bamadio by Djibril Alphagalo and Aly Alphagalo; b) for being, in Omo, Rural Municipality of Bondo, Koro Circle, In the month of March 2005, in any case less than ten years ago, an accomplice, by aiding and abetting, to the offence of rape charged against Djibril Alphagalo, particularly by providing him with the house in which the rape occurred. Whereas these undisputed facts constitute the offences of abduction, false confinement, rape and complicity, which are defined and punished by Articles 24 Paragraph 3 and 4, 226 Paragraph 3, 237 and 240 of the Penal Code and can result in application of criminal sanctions; Having regard to the said texts, together with the provisions of Article 213 of the Social, Commercial and Civil Procedure Code; FOR THESE REASONS Ruling in chambers, in criminal cases and in last resort; Finds sufficiently established against Aly Alphagalo, Djibril Alphagalo et Aguélou Alphagalo, the offences of abduction, false confinement, rape and complicity; Pronounces their indictment on the facts specified and qualified above; Issues an order of arrest against them and refers them to the Assizes Court of Mopti for trial in accordance with the law; Holds that they shall be taken into custody and detained at the Detention Centre established at the said Court;
