Considering that called to the bar, the accused tried to deny the facts by asserting that it
was with the victim's consent that he had sexual intercourse with her;
That however, he admitted having used tricks to achieve his ends;
Considering that Mr. K.A declared that he does not file a civil party action;

That it befits to rule after trial with regard to him;

A /On the public action
Considering that the accused is being prosecuted for indecent assault consumed with
violence;
Whereas it results from the investigation and from the debates at the hearing that the
accused made the victim believe that she was spiritually sinking into the darkness and
that he could deliver her by praying for her;
That he invited her to his house, asking her to bring a candle;
That once at home and alone with the victim, he asked her to get naked, in order to coat
his body with kaolin before beginning the prayer;
That used this opportunity to sexually abuse her by threatening to kill her if she resisted
on the one hand and on the other hand if she told the facts to a third person;
Considering that the accused first tried to deny the facts before admitting that the fact
of making the victim believe that she was sinking into darkness was only a simple trick in
order to attract her to his house to have sex with her,
That from the foregoing, it should be said that the facts charged to him have been
proven,
That it befits to apply to him the penal law;
B/ On civil damages
Given that Mr. K.A, elder brother of K.A, declared on behalf of the latter, that he does
not file a civil party action;
That there is reason to give him notice thereof;
C/ On costs
Considering that the accused succumbs;
