APPELLANT: HABUMUREMYI Eric, son of BAGIRUMUJINYA Fidèle and NYIRANDIMUKAGA Josephine, born in 1990, living in Musekera village, Kigabiro cell, Gashaki sector, Musanze District, Northern Province. SUBJECT: Application for review of Case No. RPA 0169/14 / HC / MUS passed by the Musanze High Court on 19/11/2014. I. FACTS AND PROCEDURE 1. The case commenced in the Rubavu High Court, where the prosecution charged HABUMUREMYI Eric with sexually assaulting a 17-year-old MUVUMBUZI Latifa. HABUMUREMYI pleaded not guilty but admitted to being friends with the girl because he considered her as an adult. The Musanze High Court convicted him of sexually abusing a child named MUVUMBUZI Latifa and sentenced him to ten years in prison. 2. HABUMUREMYI Eric was not happy with the decision and appealed to the Musanze High Court, alleging that he was given a heavy sentence while the offence did not prejudice the girl given that she consented to sex with him, and asks to reduce his sentence to five (5) years in prison. 3. On 08/06/2015, HABUMUREMYE Eric applied for review of case RPA 0169/14 / HC / MUS passed on 19/11/2014 by the High Court, Musanze Chamber alleging that he pleaded guilty and was punished. A similar case was later filed against MUHIRE Jean d'Amour, who was also accused of sexually abusing a 17-year-old child, but the Musanze High Court acquitted him in case RP 0014/15 / TGI / MUS, which is the ground for his application for review.
