2 Sentences the accused to pay him the sum of two million francs as damages; Sentences him further to costs; ON MERITS Considering that it results from the submissions that on May 10, 2013, Lady 0 A seized the police station of the second arrondissement of a complaint against the above-named for having sexually abused her underage daughter of eight years; she explained that the latter, who is a friend of her husband's, had asked her on May 7, 2013 for permission to take her daughter for a walk before bringing her back a few hours later; she continued that having noticed, three days later, that a whitish liquid was coming out of her vagina, she had pressured her with questions and she had then accused the defendant of having abused her and besides, having threatened her with death if she denounced him; Considering that questioned on these facts put in his charge, C.Y made no difficulty to admit them by explaining to have led his victim in his room to abuse her after having bought her candies; Considering that the accused of indecent assault consumed with violence repeated his declarations of the preliminary investigation as well before the Public Prosecutor as at the court; Considering that the court declared him guilty of the facts charged to him and sentenced him to ten years of imprisonment and a fine of two million francs; Considering that the accused appealed against this judgment and remained constant in his confession at the Court of Appeal; Considering that before the Court, the Public Prosecution would require the confirmation of the impugned judgement; Therefore IN THE FORM Considering that the accused has appeared; that it befits to rule by decision after he has been heard; Considering that the appeal of the accused was initiated according to the form and time limit of the law; therefore, it befits to declare it admissible; ON MERITS Considering that the accused, who does not dispute the facts against him, requests the reduction of his sentence; Considering, however, that the facts are sufficiently serious; that in fact, it emerges from his own declarations that he abused his 4-year-old minor victim after threatening her with death in the event that she would denounce him;
