English version of his confessional statement marked Exhibit ???A???. is a translated English language
version of a confessional statement admissible in evidence against an accused when same was not
signed by the accused person?
2. Under the Nigerian law of Evidence, can an accused be legally convicted for a crime of rape only on
the uncorroborated evidence or testimony of a child who has not attained the age of fourteen (14) years
tendered?
3. In criminal law, the standard of proof placed upon the prosecution is proof beyond reasonable doubt.
The right to fair hearing is also guaranteed by the Nigerian Constitution. Will prosecution be said to have
discharged the burden of proof beyond reasonable doubt and the defendant accorded fair hearing when
prosecution failed or neglected to tender before a trial Court all statements made to the Police by
defendant?
Pursuant to an order of this Court made on 13/03/2018Â

vacating our earlier order of 15/01/2018 directing the hearing of this appeal only on the Appellant???s
brief of argument, the learned Director of Public Prosecutions, (DPP), Jigawa State Ministry of Justice,
Musa M. Imam who settled the Respondent???s brief of argument filed on 09/10/2018 but deemed on
13/03/2018 identified a sole issue worthy of determination to wit:
Whether the learned trial Judge was right when he convicted and sentenced the Appellant to seven
years imprisonment based on the evidence adduced by the prosecution.
I shall determine this appeal on the Respondent???s sole issue which encapsulates the 3 issues
inelegantly formulated by the Appellant???s Counsel. But before doing so, I feel obliged, by way of
general observation, to comment on the manner in which the Appellant???s Counsel formulated his
issues for determination.
