Whereas in this case, P. F is accused of having ordered
EPKO Rosemary Akrassi to traffic in the minors D, S. E,
M.A and U.M;
That according to article 511-2, the recruitment,
transport, transfer, accommodation or reception of a minor
for commercial purposes constitutes the offence of human
trafficking; that according to paragraph 2 of article
511-1, exploitation may include the exploitation of the
prostitution of others; that it emerges from the documents in
the case file and the debates at the hearing that
EPKO Rosemary transported the minors D, S. E, M.A
and U.M from Nigeria to Burkina Faso prior to engaging
them in prostitution; that she was also convicted of the acts
of human trafficking by the court as part of previous
proceedings; that the main offence of complicity
committed by a third person is thus established;
Whereas from the investigation at the hearing, it
emerges that the accused practices prostitution
in Ouahigouya; that she contacted a person in Nigeria to
entrust girls to EPKO Rosemary Akrassi to transport
them from Nigeria to Burkina Faso; that the accused
acknowledges having sent the sum of CFAF 100,000
(one hundred thousand) to EPKO Rosemary Akrassi to
pay the transport costs of the girls from Nigeria to Burkina
Faso; that she was to receive them in her home, in view of
placing them in a prostitution network; that it is obvious
that the order to bring the above-mentioned minors
emanates from the accused; that this order constitutes the
material act of complicity required by article 131-4;
That the intention of complicity is established,
especially as the accused, together with EPKO Rosemary
Akrassi, used a ploy to recruit the girls by telling them that
they had to work in a restaurant;
That in view of the above, all the elements of complicity
in human trafficking are present; that the accused must be
maintained in connection with the offence of complicity in
human trafficking, be found guilty of it and be convicted;
B) Sentence
Whereas according to article 131*5, accomplices to a
crime or offence are punished as the perpetrators of the crime
or offence unless the law provides otherwise; whereas article
511-4 of the memo code states that the guilty party to human
trafficking is liable to 5 (five) to 10 (ten) years’ prison term and
