3°) Aguélou ALPHAGALO: Born around 1950 in Omo, Rural Municipality of
Bondo, Koro Circle, son of the deceased Anaye and of Yeire Agnou, Farmer
domiciled in Omo,
Undetained;
Having regard to the order of transfer of the procedural documents to the Attorney
General at the Court of Appeal by the Examining Magistrate of Koro on the 13th of
April 2006;
Whereas judicial inquiry established the following facts:
Halimata Bamadio, a girl aged 14, lives with her parents in the village of
Sandiourou, in the Municipality of Bondo. A few kilometres away lies the village of
Omo, of which Djibril Alphagalo is a native, and who lusted after Miss Halimata
Bamadio. On the 14th of March 2005, accompanied by her mother Amakouno
Djimde and her younger brother, Halimatou Bamadio went to the bush in search of
firewood.
Knowing that Halimatou Bamadio had gone to the bush, Djibril and his friends,
including Aly, went there on a motorcycle. Seeing them come, Halimatou clung
with all her strength to her mother. Still, she was forcefully torn from her mother
who was being withheld by some of his friends, while Djibril dragged her right to
the motorcycle driven by Aly, and carried her to the village of Omo and to the home
of Djibril’s parents. Djibril explained to his father Aguélou Alphagalo that he had
abducted the girl. Meanwhile Amakouno Djimde sent her child to the village to
notify her husband Mediou Bamadio, then went to the village of Omo in search of
