one of the security guards who should not engage is such heinous acts. The Court finds
that the reduction of the sentence from life imprisonment to thirty years’ imprisonment
is sufficient, so his appeal for a reduction of the sentence passed by the first sentence court
is unfounded.
V. DECISION OF THE COURT
[7] Declares the appeal of Bigirimana Jean Claude admissible because it had been filed
in the manner and within the period prescribed by law, but finds it baseless.
[8] Declares and orders that the judgment No. RP 0750/06 / TGI / RBV issued by the
Rubavu High Court on 19/11/2007 is unchanged except in respect of the legal costs, as
the grounds of Bigirimana Jean Claude’s appeal are unfounded.
[9] Orders Bigirimana Jean Claude to pay twelve thousand francs (12,500 Frw) in legal
costs, failing which within the time prescribed by law the State can forcibly remove it
from his property.
Issued and read in open court on 15/07/2011, by the Musanze High Court, at its
headquarters in Musanze, composed of the trial Judge Bakuzakundi Athanase, and the
