ON THE ONE HAND
Incapacitation of 30 days
Mr. Babacar BA, born in 1995 at Guediawaye to Seydou and Fatou, married
and father of 2 children, mechanic residing at Keur Mbaye FALL;
Accused of home invasion, violence, assaults and infliction of injuries;
Detained following detention warrant dated 30 April 2018;
Appearing and defending himself at the hearing in person;
ON THE OTHER HAND
Questioned the hearing of 22 May 2018, in conformity with article 384 of the
Criminal Procedure Code, the accused declared that he wanted to be judged
immediately, and the case was retained for deliberation;
The President read out seizure brief and proceeded to interrogation of the
accused;
The prosecutor requested that the law should be applied;
The defense counsel pleaded for a benevolent application of the criminal law;
The registrar took note of the statements of the accused;
The deliberations were then declared closed and the case concluded during the
day’s hearing;
Thereupon, the court, concluding its deliberation in accordance with the law,
ruled as follows:
