(PROVISIONAL ORDER)
LAWS OF THE NEW SUDAN
THE PENAL CODE, 2003.
CHAPTER 1 PRELIMINARY
Section 1Title and Commencement:
This Act may be cited as “The Penal Code, 2003” and shall come into effect on
the date of signature.
Section 2Repeal and Saving:
The Penal Code, 1994, is hereby repealed; provided that all proceedings, orders
and regulations taken or made there-under shall remain in force until repealed or
amended in accordance with the provisions of this Act.
Section 3-
Punishment of Offences Committed within the New Sudan:
(1) Every person shall be liable to punishment under this Code for
every act or omission done within the New Sudan contrary to its
provisions.
(2) In the application of this Code, courts may consider the existing
customary laws and practice prevailing in each area.
(3) For the purpose of this Code, definition of the New Sudan
includes its land, airspace, territorial waters, and all the New
Sudan ships and aircrafts wherever they are.
Section 4-
Punishment of Offences Committed Outside the New Sudan:
(1) Every person shall be liable to punishment in the New Sudan.
(a) Who by any act done outside the New Sudan is a party
whether as principal or abettor to any offence committed
either wholly or in part in the New Sudan; or
(b) Who by any act done in the New Sudan which is an
offence in the New Sudan and is also an offence under any
law in force in the place where the thing is done or
intended to be done; or
(c) Who is guilty of the commission or abetment outside the
New Sudan of any of the following offences:-
