Appeal by the plaintiff on the grounds of insufficient damages provided in a case concerning rape with violence of a school girl by the accused. In first instance, he was sentenced after admitting extenuating circumstances to 18 months of prison and a fine of 100.000 FC as well as to the payment of damages at the sum of 7,500 USD in favour of the victim, a minor girl.
The accused was sentenced to 9 years in prison and fined 100,000 FC. The convict is ordered to pay jointly with the Democratic Republic of Congo the equivalent of 100,000 USD in Congolese Francs as damages for the harm suffered.
