The Appellant had unlawful carnal knowledge of Indaba, a 13 years old girl. He was arrested, charged and tried for the offence of defilement. During the trial, he pleaded not guilty, but at the end was found guilty, convicted and sentenced to 8 years’ imprisonment. Dissatisfied with the verdict, he appealed to the High Court. The Court ruled against the decision of the lower court on grounds that the case was not proved beyond reasonable doubt as there was no nexus attributing the offence on the Appellant.
