B- MERITS 1-On Public Action a- On the guilt of DIALLO Adama Considering that FANNY Seydou is being prosecuted for acts of rape; Considering that it results from the documents of the file of the procedure, in particular the confession of the accused at the bar of the court, that he forced Ms. SOUMAHORO Fanta to have sex with him in spite of the supplications of the latter; That it is fair to say that the victim did not consent to said intimate relations, so that the facts of rape alleged against the accused are characterized against him; 2-On the costs Considering that the accused FANNY Seydou is declared guilty of the acts of rape put to his charge; That it befits to order him to pay the costs; FOR THESE REASONS Ruling publicly, after trial, in criminal matters, first instance; Declares FANNY Seydou guilty of the acts of rape against him, provided for and punished by articles 354 and 359 paragraph 2 of the penal code; In repression, sentences him to five (05) years of imprisonment; Condemns him to costs; Thus done and publicly pronounced the day, month and year above.
