BONIFACE ADONIKE V. STATE (2015) LPELR-24281 (SC)
FACTS:
The appellant Boniface Adonike requested Iwebunor Gabriel, a 5 year old girl to
buy sachet water for him. After which he lured her into his room and had carnal
knowledge of her. He was subsequently arrested and charged to court.
ISSUE: At what point will the offence of defilement be deemed complete.
JUDGEMENT:
The court held that the offence of defilement is complete when the court is
satisfied that the person defiled was under the age of 11 at the time the appellant
committed the act. There was penetration of the child's private part by the penis of
the appellant, and the evidence of the child was corroborated by independent
evidence.
