isolated place, KONATE YACOUBA seized her neck to her surprise, knocked her down,
immobilized her like a fool, undressed her and forced her to have sex despite her tears and
cries of protest, after which he threatened to kill her if she ever denounced it, and after she
gave him the assurance that she would not do it, he came to accompany her to motorbike at
her place before slipping away;
That she ended by saying that once at home, she told the facts to her mother who began to
cry because of her pitiful condition because she was bleeding a lot, and in the company of her
mother, she went to the police station where she lodged a complaint. Then, she went to the
regional hospital center to receive the care that her health required, following which a medical
certificate was issued on March 09, 2017 by doctor N'GUESSAN YAO, head of the obstetrical
gynecology service of the said hospital center;
Whereas Mss FOFANA Madoussou, mother of the complainant, testified by saying that on
March 8, 2017, her daughter returned to the house in tear and blood and explained to her
that she had just been raped by the name KONATE YACOUBA, the young man who used to
transport her goods;
Whereas interrogated by the investigating agents, KONATE YACOUBA, the accused, admitted
the facts without ambiguity;
That he explained that on Wednesday, March 08, 2017, he used tricks and led Ms KAMATE
NABARAKISSA to an isolated place, then he forced her to have sex with him, despite the fact
that she begged him to give up her project, explaining that she was still a virgin;
Whereas that at the end of the police investigation, KONATE YACOUBA was detained before
the Public Prosecutor at this Court, who opened a judicial investigation against him for breach
of trust relating to "the sum of thirty-five thousand francs (35,000 F / CFA) ”and rape;
That once indicted, he admitte during his first appearance interrogation the facts of rape on
Ms KAMATE NABARAKISSA and denied those of breach of trust; That heard on merits, he
maintained his confession with regard to the acts of rape, claiming that he simply threatened
his victim with violence in order to make her decide to have sex with him;
That for her part, KAMATE NABARAKISSA repeated her statements made at the preliminary
investigation;
Whereas after completing his diligences, the examining magistrate issued an order of partial
dismissal and transmission of the documents to Mr. Attorney General of the Bouake Court of
Appeal, who seized the Indictment Chamber, which, at the end of its due diligence, ordered
the accusation of KONATE YACOUBA for rape and his referral to the Korhogo Criminal Court;
That at the bar of court, counsel for the accused brought before any debate on merits a
request for the provisional release of his client, on the threefold ground that, on the one hand,
the accused is in unjustified detention because during the preparatory investigation, the
