Mr. Mohamed Yameogo was charged with kidnapping, an offense punishableunderarticles 240 and 241 of the Criminal Code. The Court of Appeal heard the case and referred the accused to the Assizes Court for trial in accordance with the law. A majority of the Assizes Court declared that the accused was guilty as charged, thought there were extenuating circumstances in favor of the accused. Mindful ofarticles 18 of the Criminal Code and articles 342 and 631 of the Code of Criminal Procedure,as well as article 727 andfollowing of the Civil, Commercial and Social Procedure Code, the court condemned Mr. Mohamed Yameogo to 2 years of imprisonment and 10 years of prohibition of stay.
