over the girl. The later arrival of an envoy of the father of the girl will not change in
the position of Djibril and his parents. Notably, his father Aguélou asked
Halimatou’s mother and uncle to return to their village, and the next day he will
send their daughter to them. Nothing helped.
Halimatou Bamadio stayed for three nights and four days at the home of
Alphagalo. During those nights, she suffered sexual assaults by Djibril, aided by
Aly who held down her feet. Faced with this situation, Mediou Bamadio seized the
Gendarmerie, and it was upon receipt of a summons by this authority that the
Alphagalos released Halimatou Bamadio, who ran home to her family. She was
presented by her father to the Gendarmerie, and the abductors were taken in for
questioning.
During preliminary investigation as well as judicial inquiry, the accused persons
admitted to acts of abduction, rape, false confinement and complicity of which they
are accused;

Information collected about the accused persons on their morality is favourable.
The legal expert reports conclusively attest to their full criminal liability.
Whereas it is undisputed as well as clear from the procedural documents that on the
14th of March 2005, Halimatou Bamadio, while in the bush with and under the
authority of her mother, was abducted, by means of violence and threats, by Djibril
and Aly Alphagalo; that she was taken against her will to the home of Aguélou
Alphagalo, father of Djibril who, instead of handing the girl over to her parents who
came looking for her, rather refused to hand her over, thereby offering a place of
detention; that during the three days and four nights in abduction, Halimatou
Bamadio suffered, still against her will, sexual assaults by Djibril Alphagalo; that
the latter was aided by his friend Aly Alphagalo who held down the feet of
Halimatou, allowing Djibril to carry out his acts; that moreover, Aguélou
Alphagalo, who knowingly offered the place for this confinement, could not claim
ignorance of the fact that his son engaged sexual relations with the girl Halimatou
Bamadio.
