This decision is not subject to criticism because it was taken at the discretion of the Court, but because the case was appealed by KARISA Boniface, the civil party and his lawyer claimed additional damages due to money spent to argue the case on appeal, the damages are increased to 2,000,000 Frw. III. COURT DECISION [13] Holds that the appeal filed by KARISA Boniface is unfounded. [14] Holds that there is no change in the merits of judgment RP 0116/14 / TGI / NYBE passed on 19/06/2015 by the Nyamagabe High Court in respect of the sentence of ten years’ imprisonment imposed on KARISA Boniface. [15] ORDERS KARISA Boniface to pay a compensation of 2,000,000 Frw to MAZIMPAKA Hussein, a representative of the child DUSENGIMANA Anita, in good faith and within the time prescribed by law, otherwise the State will forcibly remove it from his property. [16] DECIDES that KARISA Boniface is exempted from the costs of the proceedings because he appealed while he was imprisoned.
