MOTIVES Concerning the public action ON THE FORM Whereas the accused appeared and asserted his means of defense; That it is ground to rule on the counter argumentation. ON THE MERIT Whereas the accused denies the offences. Whereas, however, nothing justifies the accusation against him, especially as he maintains that he never had contact with this pupil who, moreover, is not under his direct authority (he teaches primary 3 and the victim is in primary 6), if nothing really had happened between them. That in addition, the victim, who was 13 years old at the time of the incident, repeated the facts at the bar with the same consistency without the slightest variation, and this, three years after the incident.
