THE COURT
Mindful of judgement No.38 of the Indictment Division of the Mopti Court of Appeal
on 28 October, 20 14 to to refer to the Mopti Court of Assizes Mr:
SIDY ADIAWIYAKOYE: Born around 1987 in Mopti, son of Mahamane and of
Naftchatou Adiawiyakoye, shepherd domiciled in Sevaré with his father named above,
Committal order of 07/12/12, LP of 12/12/12, charged with paedophilia, was
absent at the hearing,
MINDFUL of the arrest warrant issued against the above-named person and included
in the committal order:
Considering that the accused, referred to the Mopti Court of Assizes and duly
summoned following the procedures prescribed in article 323 of the Criminal Procedure Code,
was absent at the hearing;
That it falls to the court to rule by default against the accused;
Considering that sufficient evidence has been gathered from the case file against
Sidi Adiawiyakoye showing that in late 2012 in Mopti, in any case since less than ten years
now, using violence, force, threats or surprise, he committed several acts of sexual
penetration on the person of Fatomnata Ongoiba, a minor aged 13;
Acts provided for and punished by article 226 of the Penal Code;
Mindful of the said article, together with articles 308, 590 of the Civil Procedure Code,
224 and seq. of the Civil, Commercial and Social Procedure Code, which read as follows ;
Pursuant to the aforementioned and transcribed legal provisions;
SENTENCES IN ABSENTIA
Sidy Adiawiyakoye to a term of imprisonment of twenty (230) years.
Also, orders him to pay the costs under this ruling.
It is therefore ordered, adjudged and decreed publicly on the days, month and year
stated herein above.
