THEREFORE
The Appeals Court of Kinshasa/Gombe, judiciary section
After a public and due hearing of both parties;
Having heard the Prosecution, represented by Mr. BOKANGO, Substitute of the District
Attorney, in its indictment;
Having consulted the COCJ;
Having consulted the CPP;
Having consulted the CPLI and LII;
Declares the appeal of the accused MANGOLE BADIMUNIA, aka KAFOR;
Nullifies the previous judgement in all its dispositions;
Ruling again and doing what the 1st Judge should have done;
Finds the offense of extortion awarded to the accused MANGOLE BADIMUNIA not
established, due to reasonable doubt;
Finds the accusation of rape awarded to the accused established both in fact and in law,
sentencing him to 7 years of imprisonment;
Ruling on the civil interests of the victim MUMENI FENYEKE Elie, sentences him to pay her
the amount of 200.000 Congolese Francs within 6 months or face 3 months of detention;
Places the proceedings' fees under his responsibility, to be paid within 7 days or face 7 days
of detention;
Thus gathered and pronounced by the Appeals Court of Kinshasa/Gombe, in the public
hearing of the 24th May 2009, in which were seated the Magistrates MALONDA MATUNDU,
President of the Chamber, BOKUMANDJA BAKONGO and LUKAMBA MUGANZA, Advisors,
in the presence of Mr. MULAMPU, Prosecutor, and the assistance of Mr. KANGETA, the
Court's Clerk;.
