Article 10: Any trainee of a training institution under the tutelage of the Ministry of National and Technical Education who violates the provisions of this code, is liable to one of the disciplinary sanctions provided for by the internal regulations of the said institution. Article 11: In the event of violation of the provisions of this code by a trainee of a training institution under the tutelage of another Ministry, the Minister of National and Technical Education shall inform the tutelage Minister in writing for the latter to prescribe disciplinary sanction. Article 12: Any member of staff of institutions under the Ministry of National and Technical Education, bound by a private law employment contract which infringes the provisions of this code, incurs one of the penalties provided for by the Inter-Professional Collective Agreement, that is: - Written warning; Temporary layoff without pay, lasting 1 to 3 days; Temporary layoff without pay, for a period of 4 to 8 days; Dismissal. The sanction is taken by the head of the establishment or his representative after the person concerned, assisted, if he/she wishes, by a staff representative if there is one, has provided written explanations. The sanction is served in writing to the latter and the certified copy of the sanction is sent to the territorially competent labor inspector. A copy of the sanction accompanied by the official's written explanations must be sent to the Minister of National and Technical Education by the head of the establishment. Article 13: When the officer at fault is a private sector teacher or a Director of Studies, he/she incurs either one of the disciplinary sanctions provided for in Article 11, or the withdrawal of his authorization to teach or to direct. If the offence is committed by a government teacher on a pupil in a private school where he/she is employed part-time, even outside this establishment, the accused incurs one of the sanctions provided for in Article 7. In this case, the head of this private establishment sends a letter containing the written explanations of the accused to the Minister of National and Technical Education for the latter to prescribe disciplinary sanction. Article 14: When the facts constitute a criminal offense, in particular those indicated in Article 6, the perpetrator is liable to legal proceedings. The Ministry of National and Technical Education also reserves the right to become a civil party. Article 15: Workers and contractual staff of public institutions under the Ministry of National and Technical Education who violate the provisions of this code are exposed to: - the termination of their employment contract; - legal proceedings depending on the gravity of the offence. Article 16: Any member of staff of public and private institutions under the Ministry of National and Technical Education who is aware of offences or actions proven to be contrary to this code, whether in or out of school, has the obligation to inform, without delay, in writing or orally, his/her immediate superior. If he/she refrains from denouncing the offence, he/she is liable to a sanction. 4
