Whereas the Investigation has proven the following facts:
In the course of 2007, the said Bourama GUINDO known
as Brahima TOULEMEA
Became acquainted with Fatoumata TRAORE in
the Bancom Razel neighbourhood near
château; she went out with him for a month during which they had sexual
intercourse. Two months later, Fatoumata told him that he had impregnated
her. When questioned by the girl's father on whether or not he was the author
of the pregnancy,
Bourana denied being responsible before he was reported to the vice squad.
Whereas Bourama GUINDO became known as Brahir
TOULEMA at the end of the first court appearance during which he
was charged
with public indecency;
Whereas he admitted to having sexual intercourse with the girl
known as Fatoumata TRAORE;
Who was aged thirteen when the incidents took place;
Whereas furthermore the accused expressed remorse by wishing
to
marry the victim and by the same occasion accepted that he was the author of
the pregnancy;
Whereas from all the foregoing, enough charges have been
gathered from the investigation against
Bourama GUINDO known as Brahima TOULEMA for having
performed in Bamako, in the course of 2008, in any case since less than two
years now,
directly and intentionally a sexual act contrary to morals on the person of
Fatoumata TRAORE
with the circumstance that the latter was aged 31 years, acts provided for
and punished by article
255 of the Mali Penal Code
Mindful of the said article, all the provisions of the Mali Criminal
Procedure Code;
Mindful of the said articles together with the provisions of the
Mali Criminal Procedure Code,
NOW THEREFORE
Ruling in the council chamber:
Declares that the commission of the crime of public indecency
has been sufficiently established against Bourama GIUNDO now known as
Brahima TOULEMA;
Orders consequently his indictment for the crimes clearly
stated and described herein above;
Issues a warrant for his arrest and referral before the Court of
Assizes
to be tried there in accordance with the law ;
Rules that he will be arrested and placed at the detention facility
found near the said
court;
Commands and orders the chief superintendent of this
detention facility
to receive and keep him in accordance with the law,
