[Rev. 2012] Kenya Defence Forces Kenya Defence Forces CAP. 199 (2) A record entered under subsection (1) shall, unless the absentee subsequently surrenders or is arrested, or the report of the board of inquiry is annulled by the Defence Council or a subsequent board of inquiry, have the same effect as a conviction by a court-martial for desertion. 303. Establishment of internal grievance mechanism (1) The Defence Council shall establish an internal grievance mechanism which shall be under the Office of the Chief of the Kenya Defence Forces to address any complaint brought by or against a member of the Defence Forces. (2) The Defence Council shall, within ninety days of the commencement of this Act make rules of procedure with respect to internal grievance mechanism established under subsection (1). (3) The rules of procedure made under subsection (2) shall be in accordance with Article 47 of the Constitution and shall make provisions with respect to investigation and determination of any complaint by or against a member of the Defence Forces and without prejudice to the generality of the foregoing, the rules of procedure shall make provisions with respect to— (a) the procedure to be observed in lodging a complaint; (b) manner in which the complaint is to be investigated; and (c) manner in which appeals are to be made where a member of the Defence Forces has not obtained a satisfactory redress. 304. Regulations (1) Subject to the powers of the President under this Act, and unless otherwise provided for under this Act, the Defence Council may make regulations for better carrying out the provisions and purposes of this Act, and generally for the good government of the Defence Forces and, without prejudice to the generality of the foregoing, such regulations may make provision with respect to— (a) the commissioning and appointment of officers, and their terms of service, retirement, resignation and precedence, and similar matters; (b) the enlistment of recruits; (c) the administration of oaths and affirmations; (d) the promotion of officers and service members; (e) the persons, being members of the Defence Forces, in whom command over any service of the Defence Forces or any part or member thereof is vested, and as to the circumstances in which such command is vested; (f) the attachment and secondment of officers and service members under Part IV; (g) with the consent of the National Treasury, the pay, allowances, pensions and gratuities of members of the Defence Forces, including the manner of reckoning service before the commencement of this Act for pensions and gratuities; K7-129 [Issue 1]
