3) No interest shall be ordered under this section unless the plaintiff has claimed it in his
plaint.
4) Where such decree is silent with respect to the payment of interest as aforesaid, the
Court shall be deemed to have refused such interest and separate suit therefore shall
not be instituted.
110.
Cost:1) The Court, in making a final judgement, shall of its own motion, determine the
payment of the costs of the suit.
2) Costs shall include fees of advocates and experts and witnesses expenses.
111.
The Party Obliged to Pay Costs:The judgement debtor shall be ordered to pay the costs, unless the Court for sufficient
reasons otherwise directs.
112.
Delivery of Copy of Judgement and Decree:A copy of the judgement or of any part of the record shall be given to any party on
payment of fees and a copy of a decree shall be given without fees.

SUIT BY OR AGAINST TRUSTEES,
EXECUTORS, ADMINISTRATORS, MINORS OR PERSONS
OF UNSOUND MIND
113.
Representation of Beneficiaries:In all suits concerning property vested in a trustee, executor or administrator, where the
suit is between the person, the trustee, executor or administrator, shall represent the
persons so interested and it shall not ordinarily be necessary to make them parties to the
suit, unless the Court otherwise directs.
114.
Joinder of Trustees:Where there are several trustees, executors or administrators, they shall all be made
parties to a suit against one or more of them; provided that the executors who have not
proved their testator’s will, trustees, executors or administrators outside the New Sudan,
shall not be made parties unless the Court otherwise directs.
