Summary: Since its independence on 30 June 1960, the Democratic Republic of Congo is facing recurrent political crises; one of the root causes is the challenge to the legitimacy of the institutions and their leaders. This challenge has taken on particular importance with the wars that tore the country apart from 1996 to 2003. To end this chronic crisis of legitimacy and give the country every chance to rebuild itself, delegates of the political class and civil society, living forces of the Nation, united in inter-Congolese dialogue, agreed in the Global and Inclusive Agreement signed in Pretoria, South Africa on 17 December 2002, to establish a new political order based on a new democratic constitution on the basis of which the Congolese people can sovereignly choose its leaders, through free, pluralistic, democratic, transparent and credible elections. Article 14: "The government" ... "take measures to fight against all forms of violence to women in public and private life." Article 15: "The public authorities are responsible for the elimination of sexual violence used as an instrument in the destabilization and displacement of families. International treaties and agreements notwithstanding, any sexual violence committed against any person with the intention to destabilize or to displace a family and to make a whole people disappear is established as a crime against humanity punishable by law." Article 41: "The abandonment and maltreatment of children, in particular pedophilia, sexual abuse and the charge of engaging in witchcraft, are prohibited and punishable by law. The parents have the duty to take care of their children and to ensure their protection against any act of violence inside as well as outside their parental home. The public authorities have the obligation to ensure the protection of children in a difficult situation and to bring the authors of acts of violence against children and their accomplices to justice. "
