The applicants brought this application by Notice of Motion under article 50 of the Constitution and rule 3 of (Fundamental Rights and Freedoms) (Enforcement Procedure) Rules for Orders of enforcement of their fundamental rights and freedoms under articles 27, 23(1) and 24 of the Constitution, allegedly breached by the respondent or its agents and damages for the said breach. It concerns a case of arrest without search warrant and sexual harassment of a transgender woman by a Chairman of an administrative unit council. The Court finds a violation of the right to protection from any form of torture, cruel or inhuman and degrading treatment, guaranteed by article 24 of the Constitution and a violation of article 27(2) which reads: "No person shall be subjected to interference with the privacy of that person’s home, correspondence, communication, or other property’."
