Section 338 - “Brigandage with Murder”: If any one of five or more persons, who are
conjointly committing brigandage, commits murder in so committing
brigandage, every one of those persons shall on conviction, be punished
with death or imprisonment for life or for any less term and may also be
liable to fine.
Section 339 - “Robbery or Brigandage with Attempt to cause Death or Grievous
Hurt”: If, at the time of committing or attempting to commit robbery or
brigandage, the offender uses any deadly weapon or causes grievous hurt
to any person or attempts to cause death or grievous hurt to any person,
shall on conviction, be punished with imprisonment for a term not
exceeding seven years and may also be liable to fine.
Section 340 - “Making preparation to Commit Brigandage”: Whoever makes any
preparation for committing brigandage shall on conviction, be punished
with imprisonment for a term not exceeding seven years and may also be
liable to fine.
Section 341 - “Belonging to Gang of Brigands”: Whoever belongs to a gang of
persons associated for the purpose of committing brigandage, shall on
conviction, be punished with imprisonment for a term not exceeding
fourteen years and may also be liable to fine.
Section 342 - “Belonging to Gang of Thieves”: Whoever belongs to any wandering or
other gang of persons associated for the purpose of committing theft or
robbery and not being a gang of brigands, shall on conviction, be punished
with imprisonment for a term not exceeding seven years and may also be
liable to fine.
Section 343 - “Assembling for Purpose of Committing Brigandage”: Whoever is
one of five or more persons assembled for the purpose of committing
brigandage, shall on conviction, be punished with imprisonment for a term
not exceeding seven years and may also be liable to fine.
CRIMINAL MISAPPROPRIATION
Section 344 - “Criminal Misappropriation Defined”: Whoever dishonestly
misappropriates or converts to his own use any movable property, commit
criminal misappropriation.
Illustrations:(a) (“A”) takes property belonging to (“Z”) out of (“Z’s possession in
good faith believing at the time when he takes it that the property
belongs to himself. (“A”) is not guilty of theft; but if (“A”), after
discovering his mistake, dishonestly appropriates the property to
his own use, he is guilty of criminal misappropriation.
