number and to court her, which she rejected, since he knew she was a married woman
wearing a very marked wedding ring on her finger. More surprisingly, the accused started
calling NKUSU on a regular basis, making her believe he was a business man who often
traveled to China and that worked with the Chines Embassy and that could easily obtain a
Chinese Visa for her, given the amount of 1.500$ USD; At this time and since NKUSU also
needed to travel to China, the accused set a meeting in Bandalungwa, in front of Alimentation
Michael Cosmétique in order to exchange the said amount, but once she arrived at the
appointed place, the accused proposed another place which in reality was a hotel and after
the exchange of money he took the opportunity to drug her before raping her and taking the
golden chain of the 4th rank, as well as a ring in solid gold. After the fact and when NKUSU
regained a bit of lucidity, she started crying, even rolling on the ground and was taken by the
driver who had brought them there, to be taken next to her house.
After this serious event, Madame NKUSU understood that she had fell in the hands of a crook
and decided to stop answering the accused's phone calls, whom, not knowing how to contact
her again, appeared in her shop kept by her niece Nadège, whom he told to inform her aunt
that if she did not comply and give him money or stopped answering his calls, he would post
compromising images of her on Facebook and would tell her husband everything that he did
to her, sending through Bluetooth; In order to continue his crimes, the accused MOLOSSA
went to the length of setting up his headquarters at the corner of the victim NKUSU's Avenue,
in order to be able to follow and confront her each time she went out. It is thus that, facing the
above mentioned grave and dangerous threats to her marriage , the accused continued,
harassing the victim at every encounter, placing her at his mercy and not knowing what to do,
to take by force certain high-valued goods namely her second golden chain, a ring and even
money;
Not being able to take any more because she began to feel ill, NKUSU finally talked to her
sister Getou, who went to meet with the accused's mother in order to for him to stop and that
instead, the accused had the gall to, in the month of June 2012, call the victim's husband to
tell him that he needed to talk to him about some trouble with his marriage, his life and his
wife, even describing to him the interior of his home and taking from him 500$ USD, making
him believe that his wife owed him the amount.
Faced with the threats, blackmail and pressure being put on her, NKUSU had a fit and finds
herself in a psychiatric clinic suffering from puerperal psychosis; It is thus that due to a
complaint from the victim's husband MBALAKU, the Official of the Judicial Police arrested the
accused after hearing him in a formal investigation, placing him before the Prosecution whom
has seized the Court of First Instance of Kinshasa/Gombe, which pronounced the judgement
here under appeal;
