Summary: Boubacar Diarra, Mamby Diarra and Modou Coulibaly were charged with rape. The Court of Appeal having heard the case sent the accused to the Assizes Court for trial according to the law. The majority of the Assizes Court declared that the accused were guilty of aggravated rape. These acts are punishable by Article 226 of the Criminal Code; there were mitigating circumstances acting in favor of the accused. Mindful ofarticles 18 and 19 of the Criminal Code, andarticles 342 and 631 of the Criminal Procedure Code,as well as article 727 and following of the Civil, Commercial and Social Procedure Code, the court sentenced the accused to five years’ imprisonment with respite.
