(c) the place where, in accordance with express or implied terms of the contract, any money was payable. 25. Where Competent Court Cannot be Ascertained:If the defendant has no residence or place of business in the New Sudan and it is impossible to ascertain the competent Court according to the provisions of this Chapter, the Court within whose jurisdiction the plaintiff resides, or carries on business shall have jurisdiction. If the plaintiff has neither place or residence nor place of business, the Courts in the capital shall have jurisdiction. CHAPTER 5 TRANSFER OF SUITS 26. Transfer where more than one Court is Competent:(1) Any party may apply to the Court in which the suit has been instituted to have the suit transferred to any one of the other competent Courts. (2) The application shall be made at the preliminary stages of the suit, and in all cases shall not be granted where issues are framed. (3) After hearing the other party, the Court shall determine on such application considering the interests of the parties and to what extent is it useful to transfer such suit. 27. General Power of Transfer:(1) A High Court Judge may on the application of any party after giving notice to the other parties and hearing such of them as desire to be heard or of his own motion, transfer any suit pending before him or before any Court subordinate to him to any other Court subordinate to him and competent to any suit pending before any Court subordinate to him. (2) The Court of Appeal may exercise the powers provided for in sub-section (1) in relation to any suit pending before any suit pending before any Court subordinate to it. (3) The Chief Justice may exercise the powers provided for in sub-section (1) in relation to any suit pending before any Court in the New Sudan. 6
