266. Record of Sale:The bailiff shall prepare a record which shall show the procedure followed and the difficulties encountered in the conduct of the sale. It shall also specify the name of the purchase price and the mode of i8ts payment, and the presence or absence of the judgement debtor at the place of sale. 267. Sale of Shares and Other Stocks:Shares and other stocks shall be sold through a bank or a stockbroker or by such other mode as the Court thinks fit. CHAPTER 4. SALE OF ATTACHED IMMOVABLE PROPERTY 268. Warrant of Sale:(1) The warrant for the sale of the immovable property attached shall be issued by the Court conducting the execution on the application of the judgement creditor. (2) Notice of the order of sale and of the time and place of sale shall be given to the judgement debtor, the person in possession of the attached property and to all holders of registered charges. 269. Content of Warrant of Sale:A warrant of sale shall contain, in addition to the general information in respect of the names, descriptions and place of residence of the parties, the following particulars:(a) (b) (c) (d) (e) (f) 270. a detailed description of the immovable property to be sold; the amount for the recovery of which the sale is ordered; the conditions of the sale and the reserve price; the rates and taxes due and the encumbrances to which the property is liable; the time and place of sale; any other particulars which the Court considers material. Advertisement of Sale:(1) Any sale shall be advertised by posting up copies of the warrant of sale in a conspicuous place of the immovable property or a place nearby and on the Court notice board and in such other public places as the Court may direct. (2) The sale may be published in the press on the application of the interested parties. 271. Time of Sale:No sale of immovable property shall take place until the expiry of at least thirty days from the date of the publication of the notice of sale except with the judgement debtor’s written consent. 58
